Intellectual property rights – such as copyrights, designs, patents, trademarks, and trade secrets – may be the most important asset of any Canadian software start-up, yet some fail to take the steps necessary to fully realize the domestic and international potential of these rights.  This workshop will guide participants through processes for obtaining intellectual property rights in Canada and around the world, and provide strategic insights for utilizing those rights to create business value for founders, investors, and potential acquirers.

The workshop will be broken up into 4 parts:

Part 1: An Introduction to the Software IP Toolkit (30 min)
(a) Compare intellectual property rights
(b) Understand the virtues of obtaining and maintain those rights

Part 2: Utilizing Trademarks & Trade Secrets (50 min)
(a) Strategies for protecting brands
(b) Strategies for protecting the secret sauce
(c) Examples and best practices

Part 3: Utilizing Design & Utility Patents (50 min)
(a) Strategies for protecting designs
(b) Strategies for protecting ideas
(c) Examples and best practices

Part 4: Networking / Q&A (30 min)

This workshop is ideal for start-up companies interested in developing initial, additional, and/or
advanced intellectual property strategies.

About Matthew Leaper
Mathew Leaper is a U.S. Patent Attorney and a Patent Agent in Smart & Biggar’s Vancouver
office. Matthew serves clients in all aspects of patent counselling, including patent application
drafting and prosecution, primarily within the computer, electrical, and mechanical arts. He is
frequently called on by domestic and international clients to support the acquisition and
development of new technologies by advising on patentability and portfolio strategy.

About Kwan Loh
Kwan Loh is a lawyer and trademark agent in Smart & Biggar’s Vancouver office. He has over a decade of experience handling a wide range of matters across the trademark life cycle. As a
solicitor, Kwan focuses on trademark clearance, filing and prosecuting trademark applications
with the Canadian Intellectual Property Office and trademark portfolio strategy and management.
As a litigator, Kwan is experienced in handling complex trademark disputes.
